Terms of Use
The terms that apply to your use of condortransportation.us.
Effective date: 2020.
These Terms of Use ("Terms") apply to your use of condortransportation.us and its pages (the "Website"). The Website is operated by Condor Transportation 233 LLC, a North Carolina limited liability company based in Charlotte, North Carolina ("Condor", "we", "us"). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. What this Website is
The Website gives general information about Condor and its last-mile route execution services for parcel carriers, delivery networks and logistics companies. We do not sell anything through the Website, and the Website has no user accounts.
2. Acceptable use
You may use the Website for lawful purposes only. You agree that you will not:
- break any law or anyone else's rights while using the Website;
- try to gain unauthorized access to the Website, its servers, or any system or data connected to it;
- upload or send viruses, malware or other harmful code;
- interfere with the Website's operation or security, including its anti-spam and rate-limit protections;
- send automated, bulk or fake inquiries, or use the inquiry form to send advertising or spam;
- pretend to be another person or company, or give false information about who you are or who you represent;
- copy, scrape or collect content or data from the Website in a way that overloads it, or for a commercial purpose without our written permission.
We may block access to the Website, or disregard inquiries, if we believe these Terms are being broken.
3. Information only, not an offer
Everything on the Website is general information. It is not an offer, a quote, a promise or a contract.
- Volume and operating figures are historical. They describe past operations, including peak-season periods. They are not a guarantee of future volume, results or capacity.
- Capacity is not reserved. Any new operation depends on a signed agreement, route design, driver staffing, the agreed launch and ramp-up schedule, and the requirements of the market.
- Coverage can change. The current, priority and expansion areas we describe may change at any time. An area being shown on the Website does not mean we can serve it today.
- No pricing or start-date commitments. Prices, service levels, start dates and other terms are only set in a written agreement signed by Condor and the customer.
If a signed agreement between you and Condor says something different from the Website, the signed agreement controls.
4. Business inquiries
You can contact us through the business inquiry form or by email.
- Sending an inquiry does not create a contract, partnership, agency, or any obligation for you or for Condor. We review inquiries but we are not required to reply or to accept any business.
- Do not send sensitive information. Please do not include Social Security or taxpayer ID numbers, driver's license or passport numbers, bank or card numbers, passwords, health information, or confidential information or trade secrets of your company or anyone else. Unless we have signed a confidentiality agreement with you, we cannot treat what you send as confidential.
- Accurate information. You confirm that what you send is accurate and that you are allowed to share it, including any information about your company.
- Ideas and suggestions. If you send us ideas or suggestions, we may use them without owing you anything.
How we handle the information you send is explained in our Privacy Notice.
5. Driver applications
Driver applications are not handled through this Website. The Website links to Condor's driver app and onboarding portal (for example, through Google Play). The app and the portal have their own terms and privacy information, which apply when you use them. Nothing on the Website is an offer of work, an employment offer, or an independent-contractor agreement.
6. Our name, logo and content
The name "Condor Transportation", the Condor logo, and the Website's text, design and original graphics belong to Condor or to the people who license them to us. You may view and print pages of the Website for your own business evaluation. You may not use our name or logo, or copy or change the Website's content for any other purpose, without our written permission. Nothing on the Website gives you a license to use our name or logo.
Some photos on the Website are licensed stock images. They show the type of work we do and may not show Condor's own vehicles, facilities, drivers or staff. Names of other companies, if mentioned, belong to their owners; mentioning them does not mean they sponsor or endorse Condor.
7. Links to other websites and apps
The Website includes links to websites and apps we do not control, such as app stores. Those websites and apps have their own terms and privacy policies. We are not responsible for their content, availability or practices, and a link does not mean we endorse them.
8. No warranties
We work to keep the Website accurate and available, but we provide it "as is" and "as available". To the fullest extent the law allows, Condor makes no warranties of any kind about the Website, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Website will always be available, error-free, or free of viruses.
9. Limitation of liability
To the fullest extent the law allows:
- Condor will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business or lost data, that arise from your use of the Website or your inability to use it, even if we were told such damages were possible.
- Condor's total liability for any claim arising from your use of the Website is limited to one hundred U.S. dollars (US$100).
This section does not limit liability that the law does not allow to be limited, such as liability for fraud or willful misconduct. It applies only to the use of the Website. Liability under a signed service agreement is governed by that agreement.
10. Your responsibility
If you break these Terms or misuse the Website, you agree to cover the reasonable costs, losses and legal fees that Condor suffers because of it, including claims by others.
11. Governing law and where disputes are heard
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Website will be heard only in the state courts located in Mecklenburg County, North Carolina, or in the United States District Court for the Western District of North Carolina (Charlotte Division). You and Condor agree to the jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date at the top. Changes apply from the new effective date and do not apply to disputes that started before it. If you keep using the Website after a change, that means you accept the updated Terms.
13. Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later. These Terms, together with our Privacy Notice, are the complete agreement about your use of the Website. If the English and Spanish versions differ, the English version controls.
